OTTAWA - The Harper government is appealing a court order in the Omar Khadr case.

Officials confirmed today that Ottawa has filed an appeal of a Federal Court ruling that it seek the return of Khadr from the U.S. military prison in Guantanamo, Cuba.

Judge James O'Reilly ruled last month that the Conservative government's refusal to demand repatriation of Khadr offends fundamental justice.

Opposition parties have stepped up their demands that Khadr be brought home and tried in Canada, if necessary, in light of the court decision.

But last week, Foreign Affairs Minister Lawrence Cannon said Khadr, 22, is facing serious charges and that the American justice process must play out.

Khadr is thought to be the last westerner at Guantanamo.

Detainees from other western countries, including Britain and Australia were sent home long ago.
