TORONTO -- The Ontario Court of Appeal has ruled that two lawsuits against CIBC and Scotiabank regarding unpaid overtime may go ahead as class action cases.

However, the appeal court also overturned a lower court decision and ruled that a similar lawsuit against Canadian National Railway Co. may not proceed as a class action case.

The bank lawsuits allege CIBC and Scotia did not pay overtime even though workers were assigned heavier workloads than could be completed within their standard working hours.

The allegations have not been proven in court.

A lower court had denied class action status to the CIBC case, while a different court had allowed class action status be granted to the Scotiabank lawsuit.
