Assault charges have been stayed against a 69-year-old Winnipeg man suffering from the advanced stages of Alzheimer's disease.

Joe McLeod was not in court today and is residing in a long-term care home.

He was arrested Sept. 2 after becoming confused and striking his wife, Rose. He was charged with assault as Rose had a cut, requiring stitches.

Crown attorney Bruce Sychuk said Rose did not want to testify in the case, leaving the prosecution with no case.

There was a public outcry after McLeod was jailed in the medical unit at the Winnipeg Remand Centre for more than a month.

Manitoba Liberal Leader Jon Gerrard championed McLeod's case, asking how a man with Alzheimer's could be kept in jail for such a long period.

His family said they were unable to raise bail for him, as they were unable to provide 24-hour care for him.

McLeod was eventually released Oct. 8.

Rose McLeod said her husband belongs in long-term care, not in jail.
